Introduction

The Adult Drug Court is a voluntary program supervised and funded by the Douglas County District Court that allows eligible defendants, referred by the Douglas County Attorney, to earn a dismissal of their current felony charges in exchange for completing a 12-24 month program. The Drug Court program expectations is that each individual undergo an evaluation and assessment process, enter into substance abuse/mental health services and complete, undergo extensive drug urinalysis testing, weekly judicial supervision, weekly case management, and other program conditions.

The Adult Drug Court is for individuals, charged in Douglas County, who are motivated to resolve key problems in their life as they are related to the use of mood altering chemicals. Cognitive and behavioral changes related to one’s lifestyle choices are as well a key focal point in the Drug Court program.

The Adult Drug Court uses graduated sanctions and rewards to help motivate healthy and socially appropriate outcomes. The composition of the Drug Court Team is the Drug Court Judge, County Attorney, Defense Attorney, Drug Court Counselor, Drug Court Treatment Coordinator, Drug Court Clinical Director, and the Drug Court Coordinator.

The Adult Drug Court in Douglas County has two distinct tracks. Track One, established in April of 1997 diverts non-violent, first time, felony offenders into a 12 –18 month program. Track Two, established in February 2003, diverts non-violent, multiple felony, offenders into an 18-24 month program. In order to gain access to the initial admission stages of both tracks defendants are required to enter a plea of guilty on their admitting charge(s).

Track One plea hearings will be handled by the defendant’s assigned District Court Judge. Track Two plea hearings will be handled by either District Court Judge Gary B. Randall, or District Court Judge Gregory M. Schatz. In the unfortunate event of Drug Court withdrawal or termination the assigned District Court Judge to that client will proceed with sentencing responsibilities.
