PHASE
II
Phase II is the
transitional phase. The length of this phase is 120-240 days. It is
an intensive supervised phase. This phase is the 24/7 community supervision
model.
Court overview
will occur at least once every other month. The YAC team will conduct
case reviews every other week. The case review team will consist of
representatives from the County Attorney’s Office, Douglas County
Department of Corrections, State Probation, Public Defender’s
Office, Douglas County Drug Court, and Douglas County District Court
Mediation Services. A Mentoring Coordinator will provide services.
If the defendant requires treatment services, Drug Court and Probation
will collaborate to provide those services.
During this period
the defendant will:
- Be released
into the community at an approved address under electronic monitoring
for 90 days provided by probation at a rate of $5 per day.
- Be under a
curfew.
- Be involved
in any treatment identified by the Drug Court.
- Be employed
full time or involved in the work offender program at a minimum
of 20 hours per week.
- Participate
in Victim Offender Mediation.
- Be assigned
a mentor and maintain contact 2 or more times per week.
- Maintain field
and office contact with the probation officer 2 times per week.
Prior to reduction
of the original charge in this phase, a case plan will be updated
and completed by the team to address the defendant’s remaining
treatment. Upon the successful completion of Phase II and recommendation
of the YAC team, the defendant is eligible to apply to the Court,
whereby the plea is withdrawn and the felony is reduced to a misdemeanor.
The defendant is sentenced to probation and moves on to Phase III.
In certain instances the charge could be dismissed after completion
of Phase II under the discretion of the County Attorney or assigned
designate.
