INTRODUCTION
Mission
Statement:
The Young Adult
Court (YAC) is a judicially supervised program. The YAC provides a
sentencing alternative for individuals between the ages of 16-22 who
are charged with a non-violent felony to participate in a program
of selective assessment and rehabilitative services administered by
multidisciplinary agencies.
Participation:
The Young Adult
Court is targeted at felony offenders between the ages of 16- 22 who
are charged with a non-violent offense, and deemed eligible for the
program by a combination of Offense/Recidivism classification. A non-violent
felony includes all theft and non-trafficking drug offenses. The program
in the first year will be accepting up to 10 defendants. In order
to participate in this program, the Douglas County Department of Corrections
will conduct a Young Adult Court eligibility check while the defendant
is in custody based on the established guidelines at the time they
are collecting bond information for court purposes. At the arraignment,
the judge would be informed of a person’s potential eligibility
for the program. Information about the program with a set time for
a risk assessment will be provided to the defendant. The youth would
attend this risk assessment and be assessed for the program. After
assessment, a determination is made as to their eligibility. The final
decision regarding eligibility rests with the County Attorney or designate.
After
the person is deemed eligible for the program, a petition will be
filed by their attorney, and a plea date is set. The person must enter
a plea to the charged offense in front of the YAC Judge and then is
subsequently ordered to the program. If the person completes all the
requirements of the YAC program, the charge either will be reduced
to a misdemeanor or dismissed.
Structure:
Court overview
will occur at a minimum of one time per month at a time designated
by the YAC Judge. The YAC team will conduct case reviews once per
week. The case review team will consist of representatives from the
County Attorney’s Office, Douglas County Department of Corrections,
State Probation Office, Public Defender’s Office, and the Douglas
County Drug Court Office. A Mentoring Coordinator will provide services
to the program. The Probation Department will provide case management
services. The program has three phases. A case plan will be developed
to provide for primary, relapse and transitional needs. The case plan
will be updated every 6 months.
